Terms for using the Aquadock website, app, and booking interfaces.

These terms of use govern use of the Aquadock digital platform — the website aquadock.eu, the Aquadock app, and related self-service booking and information services. By accessing or using the platform, you accept these terms of use.
1. Subject matter and scope
1.1 What these terms of use govern
These terms of use govern exclusively the relationship between you as a user and Aquadock regarding use of the digital platform — i.e. the website, app, booking interfaces, user accounts, information areas, and the technical provision of booking and access information.
1.2 What these terms of use do not govern
The rental contract for water sports equipment (kayak, SUP, accessories) at autonomous Aquadock rental stations is governed exclusively by the separate rental terms and conditions (binding German version at /de/agb/). When you complete a booking, the rental contract is formed in accordance with those terms; these terms of use are not replaced thereby.
Safety-related obligations when using equipment at the station are governed by the rental terms (in particular Section 5 — safety rules) and the Safety guide — not this page.
1.3 Scope of application
These terms of use apply to registered and unregistered users (guest bookings) and to visitors who use the platform for information purposes only — regardless of access route (website, app, QR code at the station, station-specific booking pages).
1.4 Priority
If these terms of use conflict with the rental terms, the rental terms version applies to the rental contract. For pure platform use (e.g. account administration, technical availability, prohibited system use), this version applies.

3. Registration and user account
3.1 Use without an account
Registration is not required for many bookings. You may book as a guest where the booking flow allows. You must provide the data requested in the booking process truthfully and in full.
3.2 Registration and user account
Where the platform offers a user account, you must:
- provide only true, current, and complete information when registering and maintaining your account, and update it promptly when it changes,
- keep your login credentials (email, password, two-factor information where applicable) confidential and protect them from unauthorised access by third parties,
- inform Aquadock without delay if you become aware of unauthorised access to your account.
3.3 No account transfer
User accounts are personal and non-transferable. You may not share your account with third parties or make it available for bookings by others unless expressly provided for in the booking flow.
3.4 Suspension, deletion, and termination
Aquadock may temporarily suspend or permanently delete user accounts if:
- false or misleading information was provided,
- the platform is used abusively (see Section 6),
- security risks exist or there is reasonable suspicion of misuse,
- legal obligations require it.
You may request deletion of your account at any time by email to support@aquadock.eu, unless statutory retention obligations prevent this. Stored booking data may continue to be retained in accordance with the Privacy policy and legal obligations.
4. Booking system and access codes
4.1 How the booking system works
The platform enables online booking of rental periods at Aquadock rental stations. Depending on the station, the booking flow may take place via the Aquadock website, the app, a QR code on site, or integrated third-party interfaces.
4.2 Formation of contract
Upon successful payment and booking confirmation, the rental contract is formed in accordance with the rental terms. The platform provides the technical infrastructure. Aquadock remains the contracting party for the rental unless another lessor is expressly named in the booking flow.
4.3 Access code (PIN)
After successful booking, the platform provides a time-limited access code (PIN). This is usually sent by email, SMS, and/or in the app and is used to unlock the assigned locker at the booked station.
The access code:
- is tied to the respective booking, station, and rental period,
- entitles the holder solely to collect and return the booked equipment within the booked period (including any grace periods shown in the booking flow),
- is personal and non-transferable; it must not be published, shared, or used abusively.
Details on equipment use, safety rules, and liability for damage are governed by the rental terms and the Safety guide.
4.4 Validity and deactivation
The access code becomes valid and expires at the times stated in the booking confirmation. After proper return, upon expiry of the rental period, or where there is a security concern or suspicion of misuse, the code may be deactivated automatically or manually.
4.5 Failed entries and technical problems
After repeated incorrect PIN entries, the system may temporarily block access.

Aquadock endeavours to provide prompt assistance. A claim to specific response times exists only where expressly provided in the rental terms.
4.6 Your responsibility for access information
You are responsible for keeping access codes and booking confirmations secure and retrieving them only on trusted devices.
If you lose, share, or obviously misuse your access code, you are liable within the scope of the rental terms. Aquadock may block access and, where there is justified suspicion, take further steps.
5. Platform availability
5.1 Availability target
Aquadock endeavours to keep the platform available as continuously as possible. However, no minimum availability or uninterrupted operation is guaranteed.
5.2 Interruptions and maintenance
Availability may be limited by:
- planned maintenance and updates,
- disruptions at hosting or network providers,
- failures of third-party systems (e.g. payment service providers, booking service providers, mobile networks for SMS),
- force majeure or events outside Aquadock’s sphere of influence.
Aquadock is entitled to temporarily restrict or change functions where required for technical, operational, or security reasons.
5.3 Consequences of technical disruptions
If a disruption prevents booking or station access, contact support without delay.
Claims arising from the rental relationship (e.g. refund, rebooking) are governed by the rental terms, not these terms of use. There is no claim to damages solely due to temporary platform unavailability unless Aquadock acted intentionally or with gross negligence (see Sections 8.2 and 8.3).
6. User obligations
6.1 Permitted use
The platform may be used only for its intended purpose: information, booking, management of bookings and user accounts, and communication with Aquadock.
6.2 Prohibited conduct
The following is prohibited in particular:
- manipulation or unauthorised access to the platform, booking software, access systems, APIs, or security mechanisms,
- automated scraping, unauthorised crawling, or excessive load on the systems unless expressly permitted,
- circumventing access restrictions, blocks, or authentication procedures,
- sharing, publishing, or joint use of access codes (PIN),
- use of third-party accounts or identities and bookings under false information,
- distribution of malware, phishing, or other security-threatening content,
- infringement of third-party rights, in particular copyright, trademark, or personality rights,
- any use that impairs operation of the platform or rental stations or endangers other users.
6.3 Consequences of breaches
In the event of breaches, Aquadock is entitled to block access to the platform, refuse or cancel bookings, deactivate access codes, and take legal action. Further claims arising from the rental relationship are governed by the rental terms.
7. Intellectual property rights
7.1 Aquadock’s rights
All platform content — in particular text, images, graphics, videos, logos, trademarks, software, interface design, and database structures — is protected by copyright and/or trademark law. It belongs to Aquadock or is licensed to Aquadock.
7.2 Rights of use
Aquadock grants you a simple, non-transferable, revocable right to use the platform within the scope of these terms of use and the intended booking purpose. Any reproduction, adaptation, distribution, or commercial use beyond this requires Aquadock’s prior written consent.
7.3 Trademarks
“Aquadock” and related word and figurative marks may not be used without permission as your own offering, in a misleading manner, or in a form that impairs the distinctiveness or reputation of the mark.
8. Liability
8.1 User liability
You are liable to Aquadock for damage caused by your culpable conduct when using the platform — in particular misuse of login credentials, access codes (PIN), or booking functions (see Section 6).
In the case of slight negligence, your liability is limited to foreseeable, typical damage to the platform or third-party rights. In cases of intent and gross negligence, you are liable without limitation under statutory provisions.
Distinction from the rental contract. Claims arising from the rental relationship and damage to equipment are governed by the rental terms (in particular Section 6). These terms of use concern liability for pure platform use; liability for use of rented equipment at the station follows the rental terms.
8.2 Liability of Aquadock
Principle. Aquadock is liable under statutory provisions. The following sets out the extent of Aquadock’s liability for breaches of contractual obligations in connection with the platform.
Unlimited liability. Aquadock is liable without limitation in cases of:
- intent and gross negligence,
- injury to life, body, or health,
- assumption of an express guarantee or assurance.
Material contractual obligations. In the case of slightly negligent breach of material contractual obligations (cardinal duties), Aquadock’s liability is limited to compensation for foreseeable, typical damage at the time of contract formation.
What are material contractual obligations? These are obligations whose fulfilment enables proper use of the platform in the first place and on whose compliance you may rely. They include in particular:
- Booking and account: provision of booking and account functions substantially in the scope described in the booking flow,
- Access code: transmission of the booked access code (PIN) via the agreed channels (e.g. email, SMS, app),
- Data protection: protection of your personal data in accordance with the Privacy policy and applicable data protection law.
In the case of slightly negligent breach of other obligations — in particular mere ancillary duties, information, or comfort functions — Aquadock is not liable.
Exclusion otherwise. Otherwise, Aquadock’s liability for slightly negligent breaches of duty is excluded. This exclusion does not apply to claims under the preceding paragraphs (unlimited liability, material contractual obligations).
Mandatory law. The above limitations and exclusions do not apply where mandatory statutory liability provisions apply.
8.3 Platform unavailability and technical errors
Aquadock is not liable for damage that results solely from:
- temporary platform unavailability (including planned maintenance, see Section 5.2),
- transmission errors or compatibility problems with your device, browser, or internet connection,
- disruptions at third-party providers (e.g. payment service providers, hosting, mobile networks for SMS),
unless Aquadock acted intentionally or with gross negligence.
In the case of slightly negligent breach of material contractual obligations (Section 8.2), Aquadock is liable only for foreseeable, typical damage at contract formation — not for lost profit, indirect consequential damage, or damage resulting solely from temporary unavailability.
Claims regarding non-performance or defective rental services at the station (e.g. equipment condition, physical locker access) are governed exclusively by the rental terms, not these terms of use.
8.4 Access codes and user fault
You are responsible for secure handling of access codes and booking confirmations (see Section 4.6). Aquadock is not liable for damage resulting from your failure to keep access codes secure, sharing them with third parties, or retrieving them on obviously insecure devices — unless Aquadock acted intentionally or with gross negligence.
Proper transmission of the access code via the channels agreed in the booking flow fulfils the relevant material contractual obligation (Section 8.2). Consequential damage from misuse by third parties for which you are responsible may be asserted in accordance with the rental terms.
8.5 Third-party content and external links
The platform may contain third-party content or interfaces (e.g. payment service providers, map material, embedded booking tools). Aquadock is not liable for third-party content in cases of slight negligence; in cases of intent and gross negligence, Section 8.2 (unlimited liability) applies.
Liability also exists where Aquadock has positive knowledge of unlawful content and fails to act without delay.
9. Changes to these terms of use
9.1 Right to amend
Aquadock is entitled to amend these terms of use with effect for the future where required for legal, technical, or operational reasons and where the amendment is not unreasonable taking your interests into account.
9.2 Information
We will inform you of material changes by publishing the updated version at /en/terms-of-use/ (German reference at /de/nutzungsbedingungen/) and, where applicable, by notice on the platform or by email where a user account with an email address exists.
9.3 Objection and continued use
If you do not object to material changes in text form within four weeks of notification and continue to use the platform after that period expires, the amended terms of use are deemed accepted. We will point out this consequence in the change notification.
Your right to object and to request account deletion remain unaffected. For bookings already concluded, the version applicable at the time of the respective booking applies unless mandatory law requires a change.

The rental terms must be accepted when booking. Use of the platform requires awareness of these terms of use.
Processing of personal data in connection with registration, booking, access codes, and support is carried out in accordance with the Privacy policy.
11. Final provisions
11.1 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumers with habitual residence in another EU/EEA state retain the protection of mandatory provisions of their country of residence.
11.2 Place of jurisdiction
For merchants, legal entities under public law, and special funds under public law, the exclusive place of jurisdiction is Frankfurt am Main. For consumers, the statutory place of jurisdiction applies.
11.3 Online dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11.4 Severability
Should any provision of these terms of use be or become invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be replaced by a rule that comes as close as possible to the economic purpose of the invalid provision.
11.5 Currency
These terms of use are dated 7 June 2026. The current version is available at /en/terms-of-use/. The German reference version is at /de/nutzungsbedingungen/ and prevails if the texts differ.
